The prayer in the present petition is very limited one.

Petitioner was released on furlough by the Prison Authority on 02.09.2026 for a period of 14 days and he is required to surrender on 17.09.2026 i.e. tomorrow by 5:00 P.M. It is based on terms and conditions as mentioned in order dated 31.08.2026.

During course of arguments, Mr. Maggon, learned counsel for petitioner submits that the Roka ceremony of his second child, namely Abhinav, would take place on 28.09.2026 and in order to discharge his family responsibility and to oversee arrangements for the abovesaid function, the petitioner may be granted his third spell of furlough in conjunction and in continuation with the earlier order.

Admittedly, the period of incarceration of the petitioner as on 14.08.2026 is 17 years 3 months and 11 days and he has already earned remission of 3 years 11 months and 11 days and, therefore, there is no unexpired portion of sentence. His case is already before Sentence Review Board (SRB) for remission of sentence.

Keeping in mind the abovesaid peculiar facts, the present petition is allowed and petitioner is granted third spell of furlough for a period of three weeks, in continuation of his existing second spell of furlough , on the same terms and conditions as mentioned in abovesaid order dated 31.08.2026 passed by the Prison Authority.

Petition stands disposed of in aforesaid terms.

Pending application also stands disposed of.
