The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking the following reliefs:

“1. Issue an appropriate writ, order or direction directing the learned Trial Court seized of Complaint Case No. CC (NI Act) 37259/2025, titled "Up 2 Date Facility Management Services v. Samnee Auto OPC Private Limited", to proceed with the complaint expeditiously and preferably within a period of six months.

A perusal of the record shows that the complaint under Section 138 of the Negotiable Instruments Act, 1881 (hereinafter referred to as the ‘NI Act’) has been filed by the petitioner before the learned Trial Court along with an application seeking condonation of delay in filing the same.

Be that as it may, it is further evident from the various ordersheets placed on record by the complainant that the learned Trial Court is making every endeavour to expedite the proceedings.

Learned counsel for the petitioner submits that approximately 40–45 cases are pending against the respondent before various District Courts under Section 138 of the NI Act and that, in none of the said cases, the proceedings have reached the stage of cross-examination of the complainant.

In view of the facts and circumstances of the case, the learned Trial Court is directed to make every endeavour to expedite the trial, in accordance with law.

Accordingly, the present petition is disposed of. Pending application(s), if any, also stand(s) disposed of.

A copy of this order be communicated to the learned Trial Court for information and necessary compliance.
