Petitioners seek quashing of FIR No. 78/2018 dated 09.03.2018, registered at P.S. Fatehpurberi, for commission of offences under Sections 341/323/427/506/34 of IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. Some additional penal Sections were added in the charge-sheet.

The abovesaid case was registered on the basis of report lodged by respondent No.2 wherein she had claimed that her neighbors had assaulted and threatened her.

It is apprised that one cross-FIR was also registered i.e. FIR No. 223/2018. It was for commission of offences under Sections 323/341/506/34 IPC with respect to the same incident and since the abovesaid offences were compoundable in nature, requisite statements of the parties have already been recorded by the learned Trial Court. However, appropriate order is yet to be passed.

Respondent No. 2 has joined the proceedings through video-conferencing along with her father and counsel.

When asked, she reiterated the terms of the settlement and submits that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and, therefore, she would have ‘ no objection ’ if the FIR in question is quashed.

The case is at the stage of prosecution’s evidence. 9. Learned counsel for respondent No.2 also acknowledges that the cross-case is being compounded and requisite statements of the parties have already been recorded by the learned Trial Court and since the parties reside in the same neighborhood, they both have decided not to peruse their respective cases, in order to maintain peace and harmony.

Keeping in mind the overall facts of the case and the fact that parties have amicably settled their all disputes, continuing with criminal proceedings would serve no useful purpose.

Accordingly, exercising inherent powers vested in this Court under Section 528 o f Bharatiya Nagarik Suraksha Sanhita, 2023 , it is deemed appropriate to quash the instant FIR.

Consequently, to secure the ends of justice, FIR No. 78/2018 dated 09.03.2018, registered at P.S. Fatehpurberi, for commission of offences under Sections 341/323/427/506/34 of IPC, along with all consequential proceedings arising therefrom, is quashed.
