Applicant seeks anticipatory bail in case FIR No. 83/2025 dated 20.11.2025, registered at Police Station Cyber Police Station West for commission of offences under Sections 112(2)/318(4)/61(2)/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 420/120-B/34 IPC)

The prime most contention coming from the side of applicant is to the effect that he is not named in the FIR and, moreover, he is being implicated on the basis of disclosure made by his alleged co-accused which is not even admissible in the eyes of law.

A comprehensive status report has been filed by the prosecution which indicates that it is a case of cyber fraud. According to complainant, a sum of Rs. 5 lacs was got transferred in one mule bank account of Kotak Mahindra Bank from his account on 12.09.2025.

During the investigation, police reached concerned account holder i.e. Deepak. He was arrested and is in judicial custody. During interrogation, Deepak revealed the name of Shoib. When Shoib was arrested, he took the name of one Lakshay Arora. When the police interrogated Lakshay Arora, he revealed the names of Suresh and Sachin claiming them to be the mastermind. According to his disclosure, applicant Suresh and his associates used to run fraud schemes and they needed bank accounts for receiving cyber fraud money. He also revealed that after the aforesaid amount of Rs. 5 lacs was got credited in the account of Deepak, the amount was withdrawn and substantial amount i.e. Rs. 4.45 lacs was handed over to applicant Suresh only.

The other three accused, who have already been apprehended, are in judicial custody and the investigation is still on and one other accused Sachin is yet to be arrested.

As per status report, applicant was issued with notice to join the investigation but he did not come forward and remained at large. So much so, his family members refused to accept any such notice and, therefore, the notice was pasted outside his house.

Totality of the facts and circumstances go onto indicate that custodial interrogation of the applicant herein would be imperative to unearth the conspiracy behind the aforesaid cyber fraud.

Resultantly, finding no merit and substance in the present application, same is dismissed.
