Mr. Kartar Meena, Assistant Jail Superintendent, Jail No. 2, Tihar is present and submits that as per re-verification of the documents, it has come to their knowledge that applicant continues to be in custody in case FIR No. 68/2025, PS Crime Branch for offence under Section 25 of Arms Act.

He submits that due to oversight and inadvertence, when the Nominal Roll was prepared, it was mentioned that he was on bail in the aforesaid case also. It is submitted that since the applicant is not on bail in a matter which is

pending trial, his request for furlough cannot be acceded to.

Learned counsel for petitioner submits that respondent should have come up with the correct facts. He, however, in view of the aforesaid revelation of the facts, does not press for any further relief in the present petition, at this juncture. He submits that once he is granted bail in the aforesaid case of PS Crime Branch, petitioner would submit fresh application before the Competent Authority for his release on furlough.

In view of the above, present petition is disposed of, as not pressed.
