The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘ BNSS ’), corresponding to Section 482 of the Code of Criminal Procedure, 1973,

seeking quashing of FIR No. 0269/2023 dated 08.03.2023, registered at Police Station Bawana, Delhi, for the offences punishable under Sections 336, 506 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘ IPC ’) read with Sections 25 and 27 of the Arms Act, 1959, along with all consequential proceedings emanating therefrom, on the basis of a settlement arrived at between the parties.

The learned APP accepts notice on behalf of the State.

All the petitioners and respondent no. 2 are present before this Court and have been identified by their counsels and Investigating Officer (IO) concerned, Police Station, Adarsh Nagar, Delhi.

Learned counsel for the petitioners submits that the petitioners and respondent No. 2 are first cousins. The present FIR arose out of a misunderstanding and an altercation between the parties. It is submitted that with the intervention of family members and relatives, the parties have amicably resolved all their disputes and differences vide Settlement Deed dated 12.03.2025. It is further submitted that no amount is payable by either party under the settlement and nothing further survives for adjudication.

Learned APP for the State submits that, in view of the nature of the allegations, the matter may be considered in accordance with law. 8. On a query put by this Court, respondent No. 2, who has been duly identified by the Investigating Officer, states that he has entered into the settlement voluntarily, out of his own free will and without any force, coercion or undue influence. He further states that he has no objection if the present FIR and all consequential proceedings are quashed.

peculiar facts and circumstances of the present case, this Court finds that the dispute arose between close relatives and has now been amicably resolved with the intervention of family members. The parties have decided to maintain cordial relations in future and no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would amount to abuse of the process of law.

Accordingly, FIR No. 0269/2023 dated 08.03.2023, registered at Police Station Bawana, Delhi, under Sections 336, 506 and 34 of the IPC read with Sections 25 and 27 of the Arms Act, 1959, along with all consequential proceedings emanating therefrom, are hereby quashed qua the present petitioners.

The petition stands disposed of. Pending application(s), if any, stand disposed of.
