This Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), praying for the issuance of a Writ in the nature of Habeas Corpus for production of Ms. I, the minor sister of the petitioner.

On advance notice of this petition, Mr. Amol Sinha, the learned ASC, through Inspector Balram Singh, Police Station Subhash Place, has produced before us the General Diary detailing the investigation that has been made out to trace out the girl. He submits that during the course of investigation, her whereabouts were traced to Bihar, where

she was contacted and her statement was recorded. In her statement, she categorically stated that she is a major and has, out of her own free will and volition, married a boy named Prince. She also informed that she had studied in MCD Primary Co-ed School. A verification enquiry was made from the school, and it was ascertained that she is indeed a major.

Ms. I has also joined virtually in these Court proceedings and has reiterated her statement that she, out of her own free will and volition, has married a boy named Prince and is happily living with him in Bihar. From the interaction with her, we do not suspect any foul play.

As it has been ascertained that she is a major, she is entitled to decide with whom she wishes to reside.

Accordingly, no further orders are required to be passed in the present petition and the same is disposed of.

The Case Diary has been returned to Inspector Balram Singh.
