At the outset, the Status Report filed on record records as under:-

“14. In the present case, charges qua the present petitioner was framed on 26.02.2020 for offence punishable u/s 365/392/34 IPC. There are total 18 witnesses in the present case. Till date no witness has been examined in the present case due to various reasons which have been duly noted by the Ld. Trial Court in its orders passed in the present case. The main reasons as noted in the Ld. Trial Court orders are as follows:

a. Non production of accused from JC (Order dated 07.01.2020)

b. Despite issuance of production warrants, accused not produced before the Court. Accused lodged in different Jails. (Order dated 22.11.2022)

c. Several opportunity given to prosecution to lead PE despite that not a single witness has been examined till date ( order dated 14.02.2023 )

d. Witness stands discharged unexamined. Production warrants issued against accused. ( Order

e. Accused lodged in different jail and not produced physically or through VC. No witness could be examined till date for non-appearance of the accused persons. ( Order dated 25.04.2023 ) f. Perusal of the record shows that the case is fixed for PE and the accused persons who are lodged in different jail are not been produced in the Court due to which the evidence of the witness could not be recorded and he is to be discharged unexamined on each and every date of hearing. 15. The present case before the Ld. Trial Court is at the stage of prosecution evidence and is fixed for 18.04.2026.

16. It is pertinent to mention that the accused persons involved in the present case have multiple cases registered against them. The Previous Involvement / SCRB Report qua the Petitioner Sharad Pandey@Kapil is annexed herewith for the kind perusal of this Hon'ble Court.”

Considering the factual matrix as also the long pendency of the proceedings emanating from FIR No. 292/2018 as also the above Status Report, learned Trial Court is requested to make endeavours to proceed with the proceedings before it as expeditiously as possible, albeit , considering its present roster and the daily board position.

As such, the present petition is disposed of in the aforesaid terms.
