The present petition has been filed by the Petitioner under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’ ) read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the ‘ CrPC ’), seeking the following prayers:

“A. Issue a writ of mandamus or any other appropriate writ, order or direction directing the Respondents to mask the name and details of the Petitioner from all records of FIR No. 186/2021 dated 12.05.2021 u/s 354/509/34 IPC PS Vivek Vihar;

Learned counsel for the Petitioner submits that although the Petitioner has been discharged in FIR No. 186/2021 registered under Sections 354/509/34 IPC at Police Station Vivek Vihar, his name continues to be reflected in the police records and police verification records, thereby causing hardship to him in his day-to-day business.

Learned Standing Counsel appearing on behalf of the Respondents, who appears on advance notice, submits that although the name of the Petitioner cannot be deleted or masked from the records pertaining to the aforesaid FIR, the status of the case can be updated to reflect that the Petitioner stands discharged/acquitted.

In view of the aforesaid submission, it is directed that the status of FIR No. 186/2021 registered under Sections 354/509/34 IPC at Police Station Vivek Vihar shall reflect the status of the Petitioner as discharged/acquitted. 8. With the aforesaid directions, the present petition stands disposed of. Pending application(s), if any, also stand disposed of.
