By way of the present petition, the petitioner seeks quashing of FIR No. 626/2025 , registered under Sections 290 and 106(1) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’) at Police Station Mangol Puri, Delhi, and all consequential proceedings arising therefrom, in view of the amicable settlement arrived at between the parties.

The Petitioner and Respondent No. 2 are present before this Court. Respondent no.2 has been duly identified by her counsel as well as the Investigating Officer (IO) concerned.

Briefly stated, the FIR in question was registered in respect of the unfortunate accidental death of Sh. Dinesh Sah, husband of Respondent No.2, who was working as a labourer at the construction site of the petitioner. As per the FIR, the deceased suffered an electric shock while operating a water motor at the said construction site on 15.08.2025 and was thereafter taken to SGM Hospital, Mangolpuri, where he was declared brought dead. Subsequently, the parties entered into a Settlement Agreement dated 16.09.2025, whereby the petitioner agreed to pay a sum of Rs.12,00,000/- to Respondent No.2 towards full and final settlement/compensation. Out of the said amount, a sum of Rs.50,000/- had been paid through UPI and a further sum of Rs.7,00,000/- had been paid by cheque, leaving a balance amount of Rs.4,50,000/- to be paid at the time of quashing of the FIR. The investigation is stated to be pending and no charge-sheet has been filed till date.

Today, Respondent No.2, who is present in Court, states that she has received the remaining settlement amount of Rs.4,50,000/- vide Demand Draft No. 154891 and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed. The settlement records that the total settlement amount was Rs.12,00,000/-, out of which Rs.7,50,000/- had already been paid and the balance amount of Rs.4,50,000/- was payable at the time of quashing of the FIR. 7. Learned counsel for the petitioner submits that, in terms of the Memorandum of Understanding/Settlement Agreement, the entire settlement amount of Rs.12,00,000/- has now been paid to Respondent No.2, who has agreed to extend her cooperation for quashing of the present FIR and has no objection to the same.

On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence and that she has no objection if the present FIR and all proceedings emanating therefrom are quashed. The Settlement Deed and the No Objection Certificate-cum-Money Receipt also record her consent to the quashing of the FIR.

In view of the fact that the parties have amicably resolved their disputes, the entire settlement amount has been paid, and Respondent No.2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings.

Accordingly, FIR No. 626/2025 , registered at Police Station Mangol Puri, Delhi, for the offences punishable under Sections 290 and 106(1) of the BNS, and all consequential proceedings emanating therefrom, are hereby quashed.

The present petition, along with pending application(s), if any, stands disposed of.

Copy of the order be communicated to the concerned Trial Court for necessary action and compliance.
