Petitioner/CBI has assailed order dated 05.12.2025 of learned Special Judge (PC Act) CBI-03 /RACC /New Delhi, whereby since the CBI was not filing the CFSL report, the learned trial court directed the IO to produce FR-1 and FR-2 for perusal of the court.

At the outset, learned counsel for petitioner/CBI contended that the said documents FR-1 and FR-2 are confidential documents and cannot be directed to be produced by even the trial court. In this regard, learned counsel for petitioner/CBI contended that a co-ordinate bench of this Court has already taken a view, holding in favour of petitioner/CBI and that view was upheld by the Supreme Court. The judgment referred by the learned counsel for petitioner/CBI is titled as CBI vs. State of NCT of Delhi [ 2025:DHC:1307] and CBI vs. State of NCT of Delhi , [SLP (Crl . ) No.

At this stage, during the course of dictation, learned counsel for petitioner/CBI on instructions of the IO seeks permission to withdraw this petition with the request that the documents FR-1 and FR-2, which CBI shall produce before the trial court may be kept in sealed cover.

Accordingly, as requested, the petition and the accompanying applications are dismissed as withdrawn with the direction that FR-1 and FR-2 shall be produced by CBI in sealed cover before the trial court tomorrow itself, when the matter is stated to be already listed.

At request of learned counsel for petitioner/CBI it is made clear that this order shall not be treated as judicial precedent.
