The present petitions have been filed by the petitioners alleging wilful disobedience/non-compliance with the directions contained in the judgment/ order dated 28.01.2025 passed in W.P.(C) 12189/2021 & connected matters. The said petitions were disposed of, inter alia , in the following terms:

It transpires that after the aforesaid judgment/order was passed, an Office Order dated 03.10.2025 came to be issued by the Department of Training and Technical Education, GNCTD, which reads as under:

It can be seen that although Selection Grade has been granted to each of the petitioners from the date mentioned in the aforesaid judgment/order, the requisite financial benefits have not been disbursed.

During the course of hearing, learned counsel for the respondents submits that for the purpose of disbursal of the financial benefits, the petitioners are required to exercise an option to indicate the date on which they would prefer to avail the increment admissible to them. 5. It is made clear to the respondents that the financial benefits (in terms of the Rules prevalent at the relevant point of time) to which the petitioners are entitled shall be computed on the basis that increments to which the petitioners are entitled in the usual course, are granted at the earliest opportunity.

It is assured and undertaken by Dr. M.K. Gupta, Joint Director (Legal), who is present in Court, that the requisite financial benefits accruing to the petitioners shall be computed accordingly and disbursed latest within a period of 3 weeks from today. The said statement is taken on record.

Learned counsel for the petitioners submits that there is another additional aspect of the matter. He submits that in the usual course, petitioners are also required to be considered for upgradation to Selection Grade-II with effect from expiry of 3 months from the date on which Selection Grade-I was given to the petitioners. Let the said aspect be also adjudicated and for this purpose a Review DPC be held.

If the petitioners are found eligible for the Selection Grade-II, the additional financial benefits accruing thereby shall also be granted to the petitioners. Let the said exercise be completed as expeditiously as possible

and in any event, within a period of 12 weeks from today.

The respondents are expected to comply with the aforesaid directions within the timeline indicated hereinabove.

The present petitions stand disposed of in the above terms. 11. In case the aforesaid timeline is not adhered to, the same shall be construed as wilful disobedience of the orders passed by this Court on the part of the respondents, entailing severe actions against the concerned officials of the respondents, under the Contempt of Courts Act, 1971.

In case of non-compliance, the petitioners shall be at liberty to revive the present petitions.

In case the aforesaid timeline is not adhered to, the same shall be construed as wilful disobedience of the orders passed by this Court on the part of the respondents, entailing severe actions against the concerned officials of the respondents, under the Contempt of Courts Act, 1971.
