of a judgment dated 03^rd July, 2026, passed by the Additional District and Sessions Judge-Cum-Presiding Officer, Appellate Tribunal, MCD, Delhi, in Appeal No. 360/ATMCD/2025 , titled as Murai Lal Bansal (Deceased) through LRs Versus Municipal Corporation of Delhi and Anr .

The said judgment is taken on record.

Learned counsel appearing for the respondent-MCD submits that by the aforesaid judgment dated 03^rd July, 2026, the construction in the property in question, i.e., property bearing No. 51, Chappan Wali Masjid, Okhla Village, Jamia Nagar, New Delhi-110025, has been held to be protected under the National Capital Territory of Delhi Laws (Special Provision) Second Act, 2011 and the Demolition Order dated 11^th April, 2025, passed by the MCD in respect of the property in question, has been directed to be kept in abeyance.

Accordingly, no further orders are required to be passed in the present petition.

At this stage, learned counsel appearing for the petitioner submits that though part demolition action has been taken by the MCD, however, there are certain hanging portions of the demolished structure.

Accordingly, the owner/occupier of the property in question is directed to ensure that any unsafe hanging structure, be removed forthwith.

¶28

Further, the said owner/occupier is also directed to ensure that all the malba/debris which is obstructing access to the petitioner’s property, shall be removed forthwith.

¶29

The Station House Officer (“SHO”) of the local police station shall ensure that requisite is done by the owner/occupier of the property in question.

¶30

With the aforesaid directions, the present petition is accordingly disposed of.

¶31

Pending applications also stand disposed of.

¶32

The next date of hearing of 10^th September, 2026, stands cancelled.
