Learned counsel for the respondent submits that the respondent has complied with the directions contained in the order dated 04.11.2024 passed in W.P.(C) 15374/2024 inasmuch as the representation of the petitioner has been decided in terms thereof.

It is pointed out that a communication dated 30.10.2025 has been issued to the petitioner in this regard, stating as under:

This is in reference to your letter dated 01.10.2025 wherein reply in the matter has been sought which is regarding facilities to advocates visiting jails for legal interviews.

The above said Writ Petition has raised issues of providing of sitting arrangements, toilet facilities etc. for advocates visiting the Jail for legal interviews.

You are informed that all Jails have adequate sitting arrangements/drinking water facilities and toilet facilities in the MulakatJungla/ outside Deodhy for the advocates coming for interviews with prisoner(s).

Further, an order F.No.10(3786354)/CJ/Legal/2024/960-980 dated 17.04.2025 has been issued by the Competent Authority for providing adequate facilities and arrangement of basic amenities for visiting advocates in the prisons and resolve the issues raised in the above said Writ (Copy of order is enclosed).

Jail Superintendents also have been directed to extend necessary courtesies to the advocates visiting jails for conducting legal interviews. This is for your kind information please.

A copy of the order dated 17.04.2025, as referred to in the said communication reads as under:

Sub: Regarding arrangement of basic amenities such as clean drinking water, fans and toilets in all jails for visiting advocates. ”

This is in reference to WP(Civil) No.15374/2024 vide order dated 04.11.2024 passed by Hon’ble High Court of Delhi wherein the Hon’ble Court while disposing of the public interest litigation directed the D.G. (Prisons), Tihar to decide the petitioner’s representation dated 05^th September, 2024 in accordance with law as expeditiously as possible preferably within four weeks. After perusing information received from the jails, it seems that there are emergent needs for providing adequate facilities for visiting advocates in the prisons, which are as under:

2. Drinking water facility and disposable glasses should be made available in the waiting area where advocates wait for their turn.

3. Wash rooms for the Male & Female advocates should be available in waiting area.

¶33

4. A Staff/official at CPRO should guide visiting advocates and provide advance information about MCD parking facilities available Near Gate No.04 and MCD parking in front of CPRO-03, Tihar.

5. A staff/official must be deputed daily for the communication with advocates who visit for legal interviews and for signing of vakalatnama.

6. Waiting area should supplied with fans/water cooler and proper ventilation.

If the afore-mentioned basic amenities for the visiting advocates outside the jail complex are not available at the waiting area then prompt action should be taken for repair/renovation work to Improve the facilities for the visitors/advocates in co-ordination with PWD.

This is to be dealt on priority.
