The present petition alleges wilful disobedience of the directions contained in the order dated 05.12.2025, passed in W.P.(C) 18513/2025. The said order reads as under:

“1. The issue pertains to issuance of Certificate of Vending (‘ COV’ ), as petitioner has already been subjected to a survey under the provisions of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

2. Counsel for respondent, on instructions, states that the decision regarding whether petitioner is entitled to the issuance of a COV shall

be communicated to petitioner within a period of four weeks from today.

During the course of hearing, it transpires that a communication dated 23.12.2025 came to be issued by the Enforcement Department (South), New Delhi Municipal Council, New Delhi to the petitioner. The same reads as under:

Sub:- Compliance of order dt 05.12.2025 passed in WPC 18513/2025 titled as Naresh Kumar vs NDMC & Anr by the Hon’ble High Court of Delhi

With reference to the subject matter, it is submitted that the Hon’ble High Court of Delhi, vide order dated 05.12.2025 passed in W.P.(C) No.18513/2025 tiled Naresh Kumar vs. NDMC & Anr., directed the respondent to communicate the petitioner whether he is entitled to CoV within a period of four weeks from today.

2. In compliance with the aforesaid directions, the case of the petitioner has been duly examined. It is observed that the petitioner has sought CoV and has submitted certain documents in support of his claim.

3. In this regard, it is informed that the petitioner’s name was initially placed under the Not Eligible category due to insufficiency of

documents. Further, a meeting of the Town Vending Committee (TVC) was held on 06.10.2025, wherein it was decided that reasons for denial of Certificate of Vending (Cov) would be uploaded online with effect from 13.10.2025 for a period of one month. This opportunity was provided to enable such vendors to upload/update their documents online and rectify deficiencies so that their cases could be reconsidered by the TVC in accordance with the applicable scheme.

4. The aforesaid period for uploading/updating documents has since concluded, and scrutiny of the revised documents uploaded by the vendors is also concluded.

5. It is clarified that adequate opportunity was afforded to all vendors placed under the Not Eligible category to substantiate their claims by uploading requisite documents digitally. The petitioner has also uploaded documents in support of his claim which was examined and will be placed before the Town Vending Committee, which is the designated authority under the Street Vendors (Protection of Livlihood and Regulation of Street Vending) Act, 2014, for consideration and approval in accordance with the Act, the relevant Rules, and the notified Scheme.

6. The decision taken by the Town Vending Committee will be communicated to the petitioner in due course.

Learned counsel for the respondent submits that the TVC has been meeting regularly to consider applicants or persons similarly situated such as the petitioner to consider whether they are eligible for grant of provisional certificate of vending.

considered expeditiously and an appropriate decision shall be taken on the request of the petitioner for grant of provisional certificate of vending. Let the same be done within a period of four weeks from today. Let the final decision be communicated to the petitioner expeditiously thereafter.

No further orders are required to be passed in the present petition at this stage. The present petition is, accordingly, disposed of. 8. In case with the petitioner is aggrieved with the outcome of the aforesaid exercise, he shall be at liberty to avail appropriate remedies under law.
