The present petition alleges wilful disobedience / non-compliance of directions contained in the judgment dated 10.03.2025, passed by this Court in W.P.(C) 2983/2025, titled as Radha & Ors. vs. Land Acquisition Collector & Anr . The operative directions therein are as under:

“6. In view of the above, we consider it apposite to bind down the respondents to the statement made on their behalf. We direct the LAC to decide the representation dated 11.11.2024 as expeditiously as possible and within a period of eight weeks from date. The LAC shall ensure that if necessary, the reference is forwarded to the learned ADJ in the correct format within the aforesaid period.”

2. A compliance affidavit has been filed on behalf of the respondent no.1 wherein it has been stated as under:

“ 2 That the answering respondent is filing this affidavit in compliance of the order dated 10.03.2025 passed in WP(C) No. 2983/2025 and orders passed in the present contempt petition. The answering respondent reserve right to file detailed affidavit/additional affidavit/documents and to produce relevant record if any, if required or so directed at later stage by this Hon'ble Court.

That at the outset, the answering respondent tenders sincerest unqualified unconditional apology to this Hon’ble Court for the inadvertent, unintentional and non-deliberate delay in compliance of the order dated 10.03.2025 passed by this Hon'ble Court in WP(C) 2983/2025. It is humbly submitted that the answering respondent has highest regards for this Hon'ble Court and also for each and every order or direction passed by this Hon'ble Court.

That it is humbly submitted that far from violating or disobeying any order passed by this Hon'ble Court, the answering respondent cannot even think of violating or disobeying, much less wilfully or knowingly or intentionally violating or disobeying any order or direction passed by this Hon ble Court nor the answering respondent intends to violate or disobey any order or direction passed by this Hon'ble Court.

The Hon'ble High Court of Delhi disposed off the WP(C) No. 2983/2025 vide order dated 10.03.2025 thereby directing the answering respondent to decide the representation dated 11. 11.2024 within eight weeks from the date of the order. It was also directed that LAC shall ensure that if necessary, the reference is forwarded to the learned ADJ in correct format within prescribed period.

6. That pursuant to the above directions, entire record was examined by the answering respondent with respect to Award No.8/2008-09/SW dated 14.11.2008, order dated 28.02.2024 passed by the learned ADJ (Land Acquisition), Dwarka, and the representation dated 11.11.2024 submitted by the petitioner.

That after due examination of facts and settled legal position, the respondent bas forwarded the claim of the petitioner and other similarly situated persons to the Hon 'ble Court of District Judge to adjudicate the same under section 30-31 of Land Acquisition Act, 1894. Copy of the letters dated 01.01.2026 forwarding the claims of the petitioners to the Hon 'ble District Judge, Dwarka Court is annexed herewith as ANNEXURE-R-1.

8. That it is reiterated that the answering respondent has highest regard for this Hon'ble Court and for the orders/directions passed by this Hon'ble Court and far from violating any order or directions passed by this Hon'ble Court, the answering respondent cannot even

think of violating the same much less than violating such order or direction willfully or knowingly or deliberately. It is humbly submitted that there has never been any intention of the answering respondent to defy any order or direction passed by this Hon’ble Court or to delay the compliance of the order/direction. Delay in compliance of the order has occasioned in the circumstances beyond the control of the answering respondent and was neither wilful nor intentional or deliberate. The inconvenience caused to this Hon'ble Court is deeply regretted.

That in view of the above, that order has been complied with and reference has been forwarded and therefore, the notice issued in the present petition to the answering respondent may be dropped/withdrawn and the present contempt proceedings may be dismissed/disposed of by this Hon’'ble Court. It is prayed accordingly. ”

As such, it transpires that learned District Judge, Dwarka is currently seized of the matter. It also transpires that the respondent has ostensibly complied with the directions contained in the judgment dated 10.03.2025.

In the circumstances, the present petition is disposed of with liberty to the petitioner to pursue the matter before the District Judge, Dwarka Court, Delhi who is currently seized of reference under Section 30 / 31 of the Land & Acquisition Act, 1894.
