In terms of the order dated 19.01.2026, Mr. Vivek Ayyagari, learned counsel appearing for the respondent no.1, submits that an affidavit of Mr. Umesh Dityandev Dhuri, Authorized Representative of respondent no.1 has been filed.

The said affidavit is taken on record.

For the purpose of convenience, the said affidavit is extracted

“I, the above-named deponent, do hereby solemnly affirm and declare as under:

1. That I am the duly authorized representative of Respondent No·. 1 (Mangalam Organics Limited) in the present proceedings and am conversant with the facts and circumstances of this case. I am competent to depose to the matters stated herein.

2. That vide Order dated 19th January 2026, this Hon'ble Court, at paragraph 1, after hearing submissions on behalf of Respondent No. 1, observed that 'the copyright obtained by

respondent no. 1 is in respect of the process of preparing the stencil for the drape used on the cone and not the cone itself and directed that Respondent No. 1 to make good the statement by filing an affidavit to that extent. Accordingly, the present Affidavit is being filed in compliance with the said directions.

That I state and clarify that Copyright Registration No. A- 143589/2022 titled 'CAMPHOR CONE DRAWINGS' is described in the Copyright Registration Certificate as 'Artistic Work Industrial Drawing Showing Process and Method of Preparing Cone Shaped Packaging'. The said registration pertains to industrial drawings/flow chart depicting the stepwise process for preparing the stencil used for fabric cutting and draping of the cone. The aforesaid artistic work is best described as the manufacturing and draping methodology for the camphor cone product and not the cone shape of the product itself.

4. That the present Affidavit is being filed in compliance with this Hon'ble Court's directions and in the interest of justice.”

A copy of the said affidavit has also been served to the learned counsel for the petitioner.

Reading of paras 2 and 3 of the affidavit noted above, makes it clear that the respondent no.1 has asserted that its copyright registration pertains only to the stepwise process for preparing the stencil used for fabric cutting and draping of the cone rather than the cone itself. In fact, the said observation of this Court is made more apparent by the statement in para 3 of the affidavit i.e., “ The aforesaid artistic work is best described as the manufacturing and draping methodology for the camphor cone product and not the cone shape of the product itself. ”.

This Court is informed that a Suit is pending before the High Court of Judicature at Mumbai, bearing no. COM-IPR SUIT (L) 21853/2023 titled as ‘Mangalam Organics Limited vs. Patanjali Ayurved Limited’, between the same parties.

It is also informed by the learned counsel for the parties that the substratum of the Suit instituted by the respondent no.1 as a plaintiff therein, is

also the same issue which is raised herein. However, since the affidavit clearly states that the copyright registration is in respect of artistic work and not the shape of the cone itself, nothing further survives in the present petition and the same is disposed of in terms of the affidavit of Mr. Umesh Dityandev Dhuri, Authorized Representative of respondent no.1.

It is, however made clear that in respect of other objections or contentions raised by the petitioner herein, the rights to raise the same before the High Court of Judicature at Mumbai, shall remain reserved.

In view of the above, the present petition is disposed of with all the pending applications.
