Learned counsel for the petitioner submits that after filing of the present petition, respondents reached out to them and submitted that they shall clear the loans.

Learned counsel for the respondents submits that the overdue of this month shall be paid shortly. He submits that an amount of Rs. 1 Crore shall be paid to the petitioner by 25^th April, 2026.

He further submits that within two months thereafter, the entire loan amount shall be cleared.

The aforesaid statement made on behalf of the respondents is taken on record and the respondents are held bound by the same.

Learned counsel for the petitioner submits that in view of the statement made on behalf of the respondents, he does not wish to press the present petition.

Learned counsel for the petitioner submits that the flats which have been mortgaged by the respondents in lieu of the loan taken from the petitioner, ought not to be sold by the respondents without a No Objection Certificate (“NOC”) from the petitioner.

Learned counsel for the respondents submits that they shall take requisite NOC for the sale of the mortgaged flats, whenever the need so arises.

Accordingly, the present petition, along with pending application is disposed of.
