Applicant seeks anticipatory bail in case FIR No.368/2025 dated 27.06.2025, registered as P.S. Model Town, Delhi, for commission of offence under Section 306 of Bharatiya Nyaya Sanhita (BNS) , 2023 (corresponding Section 381 of IPC).

When the present application was taken up by this Court on 18.02.2026, the applicant was permitted to join the investigation. The relevant portion of the abovesaid order reads as under:-

“2. The case relates to a theft which took place on 27.06.2025.

¶15

According to complainant, she had gone for shopping with her daughter and their domestic help-Arun Kumar was left at the house and, when they returned, they found the door of the house open and the lock of the almirah broken and, when checked, they found cash amount of Rs.55 lacs and gold and diamond jewellery etc. to be missing. It was in the abovesaid backdrop that the matter was reported to the police.

4. During investigation, police was able to apprehend three accused persons i.e. Birender Kumar, Piyush Kumar Kapri and Vivek Kumar and from their possession, some cash amount and jewellery articles were also

recovered.

As per the disclosure made by the above accused persons, theft had been done, at the asking of domestic help-Arun Kumar and the almirah of the house was broken by Arun Kumar and Vivek Kumar and thereafter, some amount was distributed by all the accused persons amongst themselves. As per such disclosure, cash amount of Rs.17 lacs was left with Dilip Kumar (applicant herein).

6. Fact remains that all the abovesaid three accused have already been chargesheeted, though, further investigation in order to apprehend other accused persons is still going on.

Learned counsel for the applicant submits that even if the case of the prosecution is taken as gospel truth, it is entirely based on disclosure made by his alleged co-accused, which has no evidentiary value. It is also submitted that, even as per the CCTV footage collected by the police, the applicant herein is not seen anywhere and he is not even alleged to be one of the thieves and he is, merely, labeled as receiver of stolen property.

8. Learned Addl. P.P. for the State appears on advance notice.

9. The concerned Investigation Officer is also present and submits that coercive process has already been got issued against the domestic help, who is still at large.

10. Keeping in mind the overall facts of the case and also appreciating the allegations appearing against the applicant, he is directed to join the investigation.

11. The Investigating Officer would apprise about the date and time to him as well as to his counsel, to enable him to participate in the investigation.

12. Let no further coercive or precipitative step be taken against him, till next date of hearing.”

Learned Addl. P.P. for the State informs that in terms of the abovesaid directions, the applicant has already joined the investigation.

Admittedly, three other accused persons, who are alleged to be the actual thieves, have been arrested and are, presently, on regular bail and charge-sheet qua them has already been filed.

Taking into account overall facts and circumstances of the case, the abovesaid interim order dated 18.02.2026 is, hereby, made absolute and it is directed that applicant shall keep on assisting the Investigating Agency and would join the investigation as and when so directed. In the event of his

arrest, he be released on bail by the concerned SHO/IO/arresting officer, on his furnishing personal bond and surety bond in a sum of Rs.25,000/- each.
