Jaydev Vs State of NCT of Delhi

The applicant/accused seeks grant of regular bail in case arising out of FIR No.704/2025 dated 13.07.2025, registered at P.S. Samaipur Badli for commission of offences under Sections 109(1)/115(2)/126(2)/351(3)/3(5) of Bhartiya Nyaya Sanhita (BNS) , 2023 (corresponding Sections 307/323/341/506/34 of IPC).

Learned counsel for the applicant submits that the applicant was arrested on 13.07.2025 and is in custody since then. He also submits that investigational aspects are already over as charge-sheet has already been filed.

On the last date, learned counsel for the applicant had submitted that the applicant-Jaydev is hardly 19 years of age with no previous antecedents. 4. Nominal Roll was called and as per Nominal Roll, the age of the applicant is 20 years and he has no other involvement of any nature whatsoever.

The incident in question got triggered on a very short issue. One Savita Devi had bought a cycle for her daughter on 14.06.2025 from a shop

owned by co-accused-Yogesh. Since the abovesaid cycle was giving recurrent problems, she met Yogesh and while talking to him, a scuffle took place and during such scuffle, the applicant (younger brother of Yogesh) also joined hands. One neighbour and his son intervened but, fact remains that both the abovesaid accused alongwith one Badshah attacked them which resulted in the registration of the abovesaid FIR.

There is CCTV footage also of the incident in question. 7. Fact, however, remains that charge-sheet has already been filed and keeping in mind the young age of the accused, no real purpose would be achieved by permitting him to further incarcerate in jail.

Keeping in mind the overall facts of the case, the applicant is, hereby, directed to be released on bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with following conditions:-

(i) The applicant would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court.

(ii) The applicant would not try to come in contact of complainant and public witnesses, directly or indirectly .

(iii) The applicant shall not indulge in any further criminal activity.

¶26

The application stands disposed of in aforesaid terms.

¶27

A copy of this order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance.
