When asked, learned counsel for applicant submitted that accused was arrested on 22.08.2023 and as per Nominal Roll on record, he has already undergone incarceration for a period of more than two years and the charges have yet not been framed. He also refers to order dated 12.02.2026 passed by learned Co-ordinate Bench in Bail Application No. 361/2026 whereby keeping in mind his medical condition, he was granted interim bail. be evident from the report received from Jail Hospital.

The Court has gone through the aforesaid report, which is comprehensive in nature. It says that though, the applicant is being given requisite consideration and uninterrupted access to the advanced medical facilities, there is immediate emergency intervention to prevent any adverse or life threatening event. It is also mentioned in such medical report that he is experiencing significant difficulty in performing routine daily activities and his mobility is restricted due to lower back pain and Radiculopathy and overall functional capacity is reduced markedly. He is under medical supervision of DDU Hospital and GB Pant Hospital.

Next date before the learned Trial Court is stated to be 11.08.2026 and it is informed that supplementary charge-sheet is likely to be filed with respect to the investigation qua some other accused.

Keeping in mind the overall facts of the case and medical report dated 07.07.2026 received from Jail Hospital, applicant is granted interim bail for a period of two months from the date of his release on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions:-

(i) The applicant shall surrender his passport, if any, and will not leave the country during this period.

(ii) The applicant shall also provide his mobile number to IO/SHO concerned, which shall be kept operational at all times.

(iii) The applicant shall not indulge in any criminal activity during the period of interim bail.

iv) The applicant shall appear before the learned Trial Court on the date (s) fixed.
