Applicant seeks regular bail in case FIR No. 1021/24 dated 22.12.2024 registered at Police Station Bhalswa Dairy for commission of offences under Sections 80(2)/85/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 304-B/498-A/34 IPC).

Marriage between applicant and deceased was solemnized in Delhi on 04.07.2024 at Arya Samaj Mandir. It was a love marriage.

Fact, however, remains that on 20.12.2024, wife of the applicant committed suicide at her matrimonial home. Admittedly, during investigation, a suicide note was recovered and as per suicide note, deceased/victim had claimed that she was committing suicide of her own and nobody was responsible for her death.

prosecution evidence.

When the matter was taken up by the learned Predecessor Bench on 05.05.2026, a direction was given to learned Trial Court to prepone the date and to examine the complainant. It is, however, informed that though the date was postponed, when the matter was taken up on 03.06.2026, despite the fact that complainant (mother of deceased) was duly served, she did not appear and, therefore, learned Trial Court had to issue bailable warrants against her and next date for PE is now 16.07.2026.

Parents of applicant have also been made accused but they are, reportedly on anticipatory bail. They both were granted anticipatory bail on 03.01.2025 by the learned Trial Court. 7. Learned counsel for applicant submits that allegations are, almost, identical and moreover, the suicide note, veracity of which has been, forensically, established completely exonerates the applicant as deceased has committed suicide for some unknown reasons and as per suicide note, she did not blame anyone.

Learned Addl. P.P. for State, when pointed by the learned counsel for applicant, does acknowledge that there was direction to the investigating agency to collect the audio-clips from the family members of the deceased and to analyze the same and, so far no, audio-clips have been provided to the investigating officer.

Nominal Roll has been requisitioned which indicates period of incarceration of applicant as one year, six months and nineteen days and his overall jail conduct is also found to be satisfactory.

Keeping in mind the overall facts and circumstances of the case, albeit, without expressing any opinion over the merits of the case, applicant is

admitted to bail on his furnishing personal bond in a sum of Rs. 25,000/- with two sureties of the like amount with the following conditions:-

a) Sureties would be local.

b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed.

c) Applicant/accused shall not try to influence or intimidate the witnesses, directly or indirectly.

d) The applicant/accused shall not leave NCR of Delhi without permission of learned Trial Court.

e) The applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational till the disposal of the case.

The application stand disposed of in aforesaid terms.
