Applicant had sought interim bail for 30 days in FIR No. 505/2024 dated 18.10.2024, registered at Police Station Prashant Vihar, for offences under Section 309(6)/310(2)/311/3(5) BNS 2023 (corresponding Sections 394/395/397/34 IPC). However, in terms of order dated 17.04.2026, learned counsel for the applicant limited his request to interim bail for two weeks in order for him to meet his mother, who has already undergone a surgery, and to attend to her medical needs.

The applicant has no bad antecedents of any nature whatsoever.

Applicant’s mother is admitted in PGI Rohtak and is, reportedly, suffering from breast cancer.

verification, the mother of the petitioner has undergone surgery on 16.04.2026 and the abovesaid surgery was in relation to a lump suspected to cancerous. She has already undergone Chemotherapy .

Learned APP for the state and learned counsel for the complainant oppose the bail application for the reason that there are other family members who can take care of the mother of the applicant, during her stay at the hospital. They submit that with the assistance given by sister and brother of the applicant, the surgery was performed and keeping in mind the seriousness of the allegations, the applicant has not been able to give any cogent reason as to why he should be enlarged on interim bail.

Undoubtedly, there are other family members of the applicant who have taken care of the mother of applicant but, at the same time, keeping in mind the age of the mother of applicant and the fact that she has undergone a surgery with respect to the tumor-growth in her breast area, and the fact that the next date before the learned Trial Court is 11.05.2026, on humanitarian grounds, the applicant herein is granted interim bail for a period of ten days, to be reckoned from the date of his release, on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to satisfaction of concerned learned Trial Court. It will be entirely up to the learned Trail Court to impose any further condition upon applicant, while accepting the bonds.

Application stands disposed of in aforesaid terms.
