The accused/applicant, allegedly involved in murder seeks interim bail for 30 days on the ground that he has to undergo medical treatment for psychiatric illness. But the material on record, including the documents filed by the accused/applicant show only that he is addicted to alcohol, and that too, as was on 20.04.2023. Thereafter, there is no medical record in that regard. Rather, the status report filed by the jail authorities before the Court of Sessions ( page 69 of paperbook ) shows that there is no serious illness suffered by the accused/applicant as alleged.

Learned counsel for accused/applicant submits that the accused/applicant is suffering with acute depression and has been crying, so family of the accused/applicant wants appropriate medical treatment to be given to him. It is also submitted that in the jail, the accused/applicant was slapped by a fellow prisoner, so he is depressed.

On the other hand, learned APP for State, assisted by IO/Inspector Dinesh Kumar, has taken me through record including the manner in which the accused/applicant allegedly committed the murder. Besides, it is also submitted by learned APP for State on the basis of medical status report filed before the Court of Sessions that the accused/applicant is not suffering with any ailment for which he cannot be given appropriate medical treatment in jail dispensary.

Considering the overall circumstances, especially the detailed medical status report dated 17.03.2026 of the accused/applicant which was filed by the jail authorities before the Court of Sessions, I find no justifiable reason to allow interim bail to the accused/applicant. The interim bail application along with pending application is dismissed.
