Petitioners seek quashing of case FIR No. 481/2016 of PS Najafgarh, Delhi for offence under Section 498A/34 IPC on the ground that the complainant de facto ( respondent no.2 ) has compromised the disputes with the petitioners.

All petitioners in person as well as respondent no.2 in person, identified by IO/SI Asmita are present in courtroom. Statements of parties have already been recorded by the concerned Joint Registrar. State has no objection to this petition.

I have interacted with the parties in Hindi. It is stated by them that they have compromised all their disputes pertaining to the subject FIR. The respondent no.2 submits that she has received full and final settlement amount in lieu of all her stridhan and alimony. It is also submitted by them that marriage between petitioner no.1 and respondent no.2 stands dissolved by way of decree of divorce. No child was born from wedlock of petitioner no.1 and respondent no.2. The respondent no.2 submits that she does not wish to continue prosecution of the petitioners.

Considering the above circumstances, I am satisfied that it would be in the interest of justice not to push the parties through a full dress trial.

Therefore, the petition is allowed and accordingly the FIR No. 481/2016 of PS Najafgarh, Delhi for offence under Section 498A/34 IPC and proceedings arising out of the same are quashed.
