The present writ petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:-

“a. Pass an order thereby issuing order/ direction in the nature of mandamus or any suitable writ thereby directing the Respondent to rectify the errors in the Letter of Intent (LOI) dated 25.12.2025 and to issue/ upload the LOI with correct particular of bidder name as “Amit Sharma” and correct description of Property i.e. Plot ID 5392 (Property at Haider Puri Resi. Scheme, Revision no. 11, Area 695.25 sq. mtrs.) in the Auction conducted by DDA on 21.11.2025 to 22.11.2025, Event ID 36656) and other necessary details etc. and

b. Issue order/direction in the nature of mandamus or any suitable writ thereby directing the Respondent to start the limitation of time for making the balance payment in terms of Demand Letter dated 26.05.2026 only after rectification in LOI dated 25.12.2025. . . .”

For the reasons stated in the petition, issue notice.

Ms. Kaur, learned standing counsel accepts notice on behalf of the respondent and has handed over a corrected copy of the Letter of Intent (“LOI”) , where the particulars of the petitioner are stated correctly.

Accordingly, the LOI dated 25.12.2025 stands modified by effect of the new corrected LOI.

The copy of the corrected LOI is handed over in Court today and the same is taken on record.

In this view of the matter, the main grievance of the petitioner stands addressed and does not survive.

However, Mr. Kachwaha, learned counsel for the petitioner, states that the period allowed for making the payment of about Rs. 9 crores as stated in the demand letter dated 26.05.2026 is expiring on 25.07.2026 and due to these mistakes in the incorrectly issued LOI, the petitioner was unable to obtain loan from any financial institution for arranging this substantial amount of about Rs. 9 crores and hence, in view of the corrected LOI, the time for making the requisite payment should be extended by a reasonable period.

Ms. Kaur, learned standing counsel opposes this prayer and states that as per demand letter, the period for making the requisite payment towards the balance amount is expiring on 25.07.2026 and thereafter

further time is permitted to the petitioner subject to payment of nominal amount of interest.

She also draws my attention to Annexure-P6 being the terms and conditions of the demand-cum-allotment letter and more particularly paragraph No. 6 of the said Annexure, which is reproduced as under:-

I am unable to agree with the submission of Ms. Kaur made in opposing the request of the petitioner.

The request of the petitioner for extension in time for making the requisite payment is premised on the requirement of availing a loan facility and petitioner’s inability to avail the same due to errors in the LOI dated 25.12.2025.

A perusal of the LOI shows that all the particulars namely, name of the bidder, description of the plot, as well as the amount have wrongly been mentioned in the LOI dated 25.12.2025.

On my specific query, it is informed that the same was an inadvertent

error and due to a typographical mistake by the respondent.

It is stated by Mr. Kachwaha, learned counsel, that the petitioner is availing loan facility from financial institutions to make good the requisite payment. However, he was unable to do so because of the errors in the LOI.

I am of the view that the fault in the present factual scenario is not attributable to the petitioner but to the respondent.

Hence, I am inclined to grant further time to the petitioner in order to ensure substantial justice between the parties.

Accordingly, the petitioner shall be granted an additional period of 30 days from 25.07.2026 to make the requisite payment, without any interest.

In case the said payment is not made within the additional period of 30 days from 25.07.2026, the relevant terms and conditions of the demandcum-allotment letter as stated in Annexure-P6 shall apply.

In case the original corrected LOI is required by the petitioner, he shall approach the learned standing counsel for the respondent, who shall ensure that the same is handed over to the petitioner.

Accordingly, the petition is disposed of in the aforesaid terms.
