The present petition has been filed stating that the learned Labour Court has created a new I.D. number to the dispute raised by the respondent.

According to the petitioners, by order dated 22.03.2011, the Central Government had referred the subject dispute for adjudication and the proceedings were adjourned for filing a statement of claim with relevant documents and list of relied witnesses. The dispute was numbered as ID No. 28 of 2011.

The petitioners are aggrieved that by a subsequent order dated 04.06.2013, a separate number (ID No. 58 of 2013) has been given to the said dispute and the respondent claimant was called upon to file its claim statement as the complaint under Section 33A of the Industrial Disputes Act, 1947.

On being pointedly asked as to the prejudice caused to the petitioners, no satisfactory answer has been given.

The present petition has been pending from last more than 12 years and it is pointed out that at some stage, the petitioner had also obtained the order of stay of proceedings before the learned Central Government Industrial Tribunal cum Labour Court.

Undisputedly, the complaint raised by the respondent workmen is pending consideration which will be decided in accordance with law.

I, therefore, see no reason to entertain the present petition as the same is clearly frivolous.

The petition is, therefore, dismissed with a cost of ₹30,000/- to be paid to the respondent within a period of four weeks. Pending application also stands disposed of.
