Mr. Chauhan, Office Assistant from Happy School is present in Court today and he states that for the academic year 2024-2025 there are 38 children studying in Happy School, in fulfillment of the 25% quota for Economically Weaker Sections (EWS).

For the said reasons, the petitioner cannot be admitted in Happy School.

With respect to the next academic sessions, the petitioner is at liberty to apply through appropriate procedure and participate in the draw of lots, and if found eligible on the said draw of lots, he shall be granted

admission to any school allotted to him by due procedure including the Happy School.

Since it is a question involving elementary education of a child, which is duly protected under the Right of Children to Free and Compulsory Education Act, 2009, the petitioner shall give a list of three government aided schools in the vicinity/locality of the petitioner, where the respondent No. 2/DoE shall make an endeavour to accommodate the child. The entire exercise shall be completed expeditiously and not later than 10 days from today.

Similar submission has also been made by the respondent No. 1/MCD in paragraph No. 13 of its compliance affidavit.

With these directions, the petition is disposed of.
