The present petition was filed by Mr. Jeet Singh, who now has expired. The petition is being prosecuted by his legal heirs. It is the case of the petitioners that they are absolute and rightful owner of residential Khasra No.36/12/2, 13/2, 18 Gali No.19, B-Block situated at Village Mubarakpur Dabas also known as Dabas Hot/Metha Panni, Delhi.

According to the petitioners, in absence of a proper approach road of public gali extending till the boundary of the petitioners’ property, the premises is rendered useless and inaccessible by any means. The respondent – DDA in its reply has taken the following position:

direction to the respondent no. 2 to extend the public Gali /access road upto the petitioner’s property and claimed to be owner of Kh. No. 36// 12/2, 13/2 & 18 of Village Mubarakpur, Delhi , it is submitted that as per L.R . DDA Kh. No . 36/12/ 2 (3-00 ), 13/2 (4-04) & 18(6-03) of Village Mubarakpur Danas has teen acquired vide Award No. 16 / 2005-06/ DC(N.W ). A copy of extract of Award No. 16/ 2005-06/DC/ N-W is annexed herewith as Annexure R- l . The physical possession of Kh. No. 36//18 min. ( 0 - 10 ) handed over to DDA by LAC/L& B Dept, GNCTD on 04.04.2006 and rest of the land of above said khasra nos. has not been handed over to DDA by LAC / L& B deptt. GNCTD due to built up. The land bearing Kh. No. 36//18 min .( 0- 10 ) handed over to DDA by LAC/L&B deptt. GNCTD has already been further transferred to Engg. Dept , on 14.11 .2006. A copy of possession proceedings and transfer papers are annexed herewith as Annexure R-2( colly .).”

It is, thus, seen that as per the DDA the land has been acquired and is handed over to the Engineering Department. The petitioners contest the said position and they submit that the land which has acquired is situated elsewhere and the petitioners’ land has not been acquired. If that is the position, the petitioners will have to take appropriate remedy in accordance with law. The aforesaid aspect cannot be adjudicated under Articles 226 and 227 of the Constitution of India.

Reserving that liberty, the instant petition stands disposed of along with all pending applications.
