This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-

“(a) a Civil Writ of Mandamus under Article 226 of the Constitution of India seeking direction to Respondent to process and decide the pending application dated 18.11.2024 (Annexure P1) of Petitioner Institution for the academic session 2026-27, which application was submitted by the Petitioner for seeking grant of approval for “B.Sc. Clinical Psychology (Hons) in Special Education” course; expeditiously and preferably within a period of two weeks, following the principle of natural justice; . . .”

For the reasons stated in the petition, issue notice.

Mr. Kumar, learned counsel accepts notice on behalf of the respondent and requests for some time to obtain instructions.

From a perusal of the prayer clause of the present petition, it is clear that the petitioner Institute only prays for decision on its pending application dated 18.11.2024 and it is the right of the petitioner get his application decided by the respondent Council.

Mr. Kumar, learned counsel for the respondent, vehemently opposes the said prayer which is only seeking processing of the application of the petitioner Institute and decision on the same.

For the said reasons, I am of the view that the petition needs to be allowed as the pending application of the petitioner Institute needs to be decided.

Accordingly, the petition is allowed and the pending application dated 18.11.2024 shall be processed and decided by the respondent within 4 weeks from today.

The petition is disposed of in the aforesaid terms.
