The present petition has been filed seeking setting aside/quashing of the withdrawal order dated 16.05.2025 issued by the Respondent/NCTE, whereby the recognition granted to the Petitioner institution for the P.T.C. course has been withdrawn with effect from the academic session 20252026.

Learned Counsel for the Petitioner submits that the impugned withdrawal order dated 16.05.2025 deserves to be stayed inasmuch as the Petitioner institution could not submit the PAR owing to technical glitches

on the NCTE portal and, further, the show cause notice was received by the Petitioner after expiry of the stipulated period for filing the response. He submits that the Petitioner is similarly placed to the petitioners in Teachers Training College Mirza v. NCTE &Anr. , W.P.(C) 5369/2025 and Late KalpnathMahavidyalay v. NCTE &Anr., W.P.(C) 730/2026 decided by this Court vide orders dated 15.12.2025 and 19.01.2026 respectively.

Learned Counsel for the Respondent/NCTE, who appears on advance notice, submits that the issue raised in the present petition is covered by the order dated 19.01.2026 passed by this Court in Late Kalpnath Mahavidyalay (supra). He further submits that the said petition has already been allowed in terms of the judgment dated 15.12.2025 passed in Teachers Training College Mirza (supra).

Accordingly, the present writ petition is allowed, holding that the directions passed by the Coordinate Bench in paragraph Nos. 12 to 16 of the judgment of Teachers Training College Mirza (supra) shall apply to the Petitioner as well, including the direction permitting the petitioner to participate in the counselling session for the academic session 2025-26. The said paragraph Nos. 12 to 16 are reproduced hereinbelow for ease of reference:

“12. In light of the above, and having regard to the decision taken by the NCTE in its 68th (General) Body Meeting as noted above, as well as, the statement made by Mr. Kapoor, the present petitions are allowed and the impugned orders are set aside.

13. Resultantly, the respondent NCTE will pass an “order of restoration” of recognition in each case and the names of the petitioners shall be included in the list of recognized institutions maintained on the website of the respondents. 14. Simultaneously, status of the petitioners as “recognized

institution” shall also be communicated to the concerned State Government and Affiliating Body or University. 15. The above exercise of passing an order of restoration of recognition as well as communicating the State Government and Affiliating Body/University shall be completed before the issuance of public notice as mentioned in para 8 (ii) above.

16. In the meanwhile, petitioner institutes are permitted to participate in the counselling for academic session 2025-26 and admit students for the said academic session.”

The present petition, along with pending application(s), if any, stands disposed of.
