Petitioner counsel admitted that, in view of the decision of the Commissioner of Police, Delhi dated 18.05.2022, the Ambulance Cadre Staff stood merged with analogous and identically designated posts in the Executive Cadre, but submitted that the merger had not been effected with the analogous posts — a plea never raised before the Central Administrative Tribunal. As the notification dated 18.05.2022 was issued pursuant to the CAT's direction, the Court granted the Petitioners liberty to file a fresh O.A. before the CAT challenging the validity of the order dated 18.05.2022, and directed the CAT, considering the long pendency, to endeavour to dispose of any such petition expeditiously. Learned counsel representing the Petitioners admits that, in view of the subsequent decision taken by the Commissioner of Police, Delhi, on 18.05.2022, there has been a merger of the Ambulance Cadre Staff of Delhi Police with analogous and identically designated posts in the Executive Cadre of the Delhi Police.

However, learned counsel representing the Petitioners submits that the merger has not been effected with the analogous posts. This aspect was never taken up before the Central Administrative Tribunal [hereinafter referred to as ‘CAT’]. Since the notification dated 18.05.2022 was issued pursuant to the direction of the CAT, hence, if the Petitioners have any grievance, they shall have liberty to file fresh Original Application (O.A.) before the CAT in order to challenge the validity of the order dated 18.05.2022.
