This order is being passed in furtherance of the order dated 14.01.2026.

On 14.01.2026, keeping in view the urgency and the facts of the case, the Union of India was directed to take instructions from Indian Embassy in Russia regarding the status of the petitioner’s attestation of Degree.

Mr. Mishra, learned counsel for the respondent No.3 has handed over a communication dated 15.01.2026, wherein it has been stated that there is no document in respect of the petitioner pending attestation with the

Mr. Singh, learned counsel for the petitioner states that the petitioner has already applied for apostilled certificate from the Ministry of Foreign Affairs in Russian Federation and the same is taking time. He also states that the exam is fixed for tomorrow and the petitioner may be permitted to take the exam.

In the present case, the requirement for getting the documents attested is prevalent since 26.09.2009. India became a party to the Hague Apostille Convention, 1961 in the year 2005.

The information bulletin issued by National Board of Examination i.e. respondent No. 1 was published on 14.11.2025. Clause 2.14 of the Information Bulletin for FMGE December, 2025 reads as under:-

2.14. The foreign medical degrees should be attested either by the Embassy of India or should be Apostilled by the appropriate authority of the foreign country concerned. Kindly note that the apostilled/attestation is to be in accordance with the requirements of Hague Convention of 5 October 1961 abolishing the requirement of legalisation for Foreign Public Document ( Apostille Convention ). For details regarding Apostilled documents, candidates may refer to the website of Ministry of External Affairs, Govt. of India. Unattested certificates / Certificates attested after the last date prescribed for submission of documents ( i.e. 02.01.2026 ) shall not be considered for the purpose of eligibility for FMGE December 2025.

In the present case, the Degree of the petitioner is dated 27.06.2025 . As

per the Information Bulletin for FMGE December, 2025 , the cut-off date for submission of duly attested/apostilled documents was 02.01.2026, beyond which no candidate was to be permitted to appear in the examination.The petitioner was, therefore, aware that nonfulfilment of the said mandatory requirement within the stipulated timeline would entail the consequence of ineligibility to appear for the FMGE. No satisfactory explanation has been furnished by the petitioner as to why the petitioner waited till the last minute to remove the deficiencies.

Even though the Court is sympathetic towards the petitioner, but is unable to help the petitioner.

Hence, the petition is dismissed.

The brief note on behalf of respondent No. 1 handed over in court today, is taken on record.

Pending applications, if any, also stand disposed of.
