This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-

“a. Issue a Writ of Mandamus or any other appropriate writ, order or direction to Respondents to immediately open the admission window for the Petitioner for a period of 7 days or any such reasonable period as deemed fit;

b. Issue a Writ of Mandamus or any other appropriate writ, order or direction to the Respondent No.1 and Respondent No.4 to accept the Part Academic Fee of Rs. 96,000/- and the remaining fees from the Petitioner and complete his admission formalities for the MBBS Course for the Academic Session 202526 against the seat allotted to his in the Special Stray Vacancy Round;

c. Issue a Writ of Mandamus or any other appropriate writ, order or direction that the seat allotted to the Petitioner (Roll No. 103251000789) at Dr. BSA Medical College be kept vacant and not treated as a stray vacancy until the disposal of this petition;”

The brief facts are that the petitioner appeared for the National Eligibility Cum Entrance Test (NEET-UG) 2025 conducted on 04.05.2025 and the result of the same was declared on 14.06.2025, wherein the petitioner secured an All India Rank (AIR) of 33701. Thereafter, the petitioner duly registered with Guru Gobind Singh Indraprastha University (GGSIPU) i.e., respondent No. 1 for MBBS Counselling (Prog Code 103) and paid the requisite counselling fees.

The petitioner participated in four rounds of counselling and subsequently, a 5^th round, namely “Special Stray Vacancy Round”, was conducted on 18.12.2025 to fill the remaining vacant seats and the petitioner participated in the same.

Prior to declaration of results of 5^th round, the respondent No. 1 issued Notification dated 26.12.2025 titled “Schedule of Activities Pursuant to the Declaration of Result of Special Stray Vacancy Round”, wherein the respondent No. 1 provided a deadline for payment of part Academic Fee

(amounting to Rs. 96,000/-) till 30.12.2025 (11:59 PM), and thereafter, for reporting to the Allotted Institute from 29.12.2025 to 31.12.2025.

On 02.01.2026, the respondent No. 1 published a public notice/list on its website titled “GGSIPU_MBBS ALLOTTED CANDIDATES_SPECIAL STRAY ROUND_2025-2026”. The petitioner found his roll number listed against Dr. BSA Hospital, Medical College i.e., respondent No. 4.

On 03.01.2026, the petitioner discovered that he was allotted a seat in respondent No. 4 college and consequently, rushed to the college authorities to complete admission formalities but was informed that his admission could not be processed as the portal was closed and the deadline had passed.

The petitioner wrote to the concerned authorities as well as the respondent No. 1 seeking extension and grant of admission, however, the same was of no recourse.

It is stated that the National Medical Commission i.e., respondent No. 2 has issued a Public Notice dated 05.01.2026, calling upon all the Medical colleges/Institutions to submit the requisite admission details of all the students admitted for MBBS during the current academic year 2025-26, vide the NMC portal latest by 15.01.2026, 12:00 mid-night.

Hence, the present petition.

Mr. Kapoor, learned counsel for the petitioner, states that only 3 days window was provided to deposit the fee and as the petitioner could not keep a check on the website for result, he was unable to deposit the fees within such short period. He further states that the petitioner is ready and willing to deposit the fees and take steps for regularization of the admission.

For the said reasons, issue notice.

Ms. Sahani, learned counsel accepts notice on behalf of the respondent No. 1. Mr. Jain, learned counsel, appearing for Ms. Manisha Agrawal Narain, learned counsel, accepts notice on behalf of the respondents No. 2 and 3. Ms. Gupta, learned counsel accepts notice on behalf of the respondent No. 4.

It is stated that the seat remains vacant at this time. 14. However, Ms. Gupta, learned counsel for the respondent No. 4, states that a list has already been sent on 13.01.2026. However, since the deadline for the Medical colleges/Institutions to submit the requisite admission details of all the students admitted for MBBS during the academic year 2025-26 is 15.01.2026, another list can be sent and should be sent including the name of the petitioner.

In the present case, the petitioner has secured admission in “Special Stray Vacancy Round” of counselling on merits and is ready and willing to deposit the fees and take steps for regularization of the admission. 16. The petitioner shall approach the University for verification of his documents and if found in order will be permitted to deposit his fee. 17. With these directions, Mr. Kapoor, learned counsel for the petitioner does not press the petition and accordingly, the present petition is disposed of along with pending applications, if any.

In case there is any surviving grievance, the petitioner will be liberty to revive the petition.
