This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-

“a. Issue appropriate Writ directing the Respondent Authorities to produce before this Hon'ble Court the entire record and files in respect of Plot Nos. 109 and 110, Vardhman C.H.B.S., Arihant Nagar, Punjabi Bagh West, Delhi-110026; AND

b. Issue Writ, Order, Direction in the nature of Mandamus or other appropriate order(s) directing the Respondent Nos. 1 and 2 to demolish the illegal I unauthorized structure erected at Plot No. 109 and 110, Vardhman C.H.B.S., Arihant Nagar, Punjabi Bagh West, Delhi-11 0026 and to direct the Respondent Authorities to ensure that no unauthorized construction is made on the aforesaid property and to take appropriate action against the violator; AND

c. Issue appropriate order(s) or direction(s ), thereby directing the Respondent No. 1 to initiate departmental proceedings against the erring officials as per law; AND…”

Ms. Mahajan, learned counsel appears on behalf of respondent Nos. 4 and 5 and has handed over an affidavit of respondent No. 4 stating that respondent No. 4 will himself remove the illegal/ unauthorized wall constructed at site of the plot within maximum period of 30 days from today.

Taking the said affidavit on record and binding the respondent No. 4 to the same, the petition has become infructuous and is accordingly disposed of.

In case the wall is not removed, the petitioner shall be at entitled to revive the present petition and file the contempt petition.
