This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-

“A. Issue a Writ of Mandamus or any other appropriate Writ, Order, or Direction directing the Respondent, i.e., St. Mark's World School, Meera Bagh, New Delhi, to forthwith issue the Transfer Certificate of the minor child, Master Atharva Iyer (Admission No. 7305, Class II-D);

B. Direct the Respondent to refrain from marking the minor child as absent from its rolls during the pendency of this petition, and to correct all such entries made on and after 21.03.2026, the date of the first TC request;

C. Direct the Respondent to refund the Annual Charges of Rs. 7,315/- paid by the Petitioner on 09.03.2026 for Academic Year 2026-27, being fees paid for a period when the child is no

The case of the petitioner is that the petitioner is the father of the Master Atharva Iyer (Admission No. 7305/Class- II-D) and has requested the respondent i.e., St. Marks World School Meera Bagh, New Delhi, for the Transfer Certificate.

Mr. Mishra, learned counsel accepts notice on behalf of the respondent and states that the respondent school has no objection to issuance of a Transfer Certificate but the same requires a No Objection Certificate (“ NoC ”) from the mother of the child as well. He further states that the petitioner and his wife are in a matrimonial dispute and hence, there is all the more requirement for the NoC.

I am of the view that the submissions of the learned counsel for the respondent are reasonable.

The petition is disposed of directing the respondent to issue Transfer Certificate in accordance with its rules and regulations, once the mother of the child gives the NoC.
