At the outset, Mr. Sriharsha Peechara, ld. Standing Counsel for the NDMC has informed the Court that the Petitioner is related to two other Petitioners who have also filed writ petitions being W.P.(C) 3114/2026 titled ‘Akbar Ali v. NDMC and Anr.’ and W.P.(C) 3144/2026 titled ‘Farman Ali

The case of the Petitioner is that he has been vending opposite DLF Mall, Sarojini Nagar Market, New Delhi and in support thereof, challans dating back to 2017 have been produced by the Petitioner.

The Court has been informed that the survey itself has already concluded in the Sarojni Nagar Area. Lists are also stated to have been drawn up. Under these circumstances the prayer for participating in the survey cannot be acceded to at this stage.

If in future a fresh survey takes place, the Petitioners are free to participate in the same in accordance with law.

It is made clear that this Court has not checked the credibility or genuinity of the claims of the said Petitioners.
