The present petition has been filed by the Petitioner- Amit Gupta under Article 226 of the Constitution of India, inter alia , seeking directions to the Respondents to conduct the survey of the Petitioner and issue a Certificate of vending (hereinafter, ‘CoV’) .

The case of the Petitioner is that his father used to squat and run a kiosk near the office of the Registrar of Cooperative Societies, Parliament Street, New Delhi (hereinafter, ‘the site’) .

The Petitioner is stated to have been vending from the site since 2000. However, sometime in 1976, his father was also offered a kiosk at Krishi Bhawan, which did not materialise.

Presently, the Petitioner is selling chole kulche from the site. The grievance of the Petitioner in the present petition is that he was not surveyed

in the recent Survey conducted by the Town Vending Committee, NDMC.

Mr. Sriharsha Peechara, ld. Counsel for NDMC submits that the Petitioner did not participate in the survey that was conducted by the Town Vending Committee and the survey has already been concluded. It is further submitted that the Parliament Street Area is a `No-vending zone’.

Under these circumstances, the only order that can be passed is that the Petitioner would be permitted to pursue his claims under Section 4(2) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act 2014, if any survey is being conducted by the Town Vending Committee, in the future. The same shall be dealt with in accordance with law. The validity or genuinity of the claims of the Petitioner, have not been verified by the Court.

The petition is disposed of in above terms. Pending applications, if any, are also disposed of.
