This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

“i. issue a writ of mandamus or any other suitable writ, order or direction to the respondents to migrate the data of admitted trainees of petitioner institute from Directorate of Employment & Training (DET) portal, Bihar to the NCVT MIS portal (known as "Skill India Digital Hub" (SIDH) platform) in time bound manner and to enable generation of hall ticket for the examination; and/or...”

The petitioner is seeking migration of the data of 38 admitted trainees of the petitioner institute from Directorate of Employment & Training (DET) portal, Bihar to the NCVT MIS portal known as “Skill India Digital Hub” (“SIDH”) platform.

The brief facts of the case are that the petitioner after admission of trainees uploaded the data of 38 trainees on the state portal but the admitted trainees were shown on the said portal as “shift one” instead of “shift two”. The petitioner raised this grievance before the nodal directorate, which duly corrected the shift of admitted trainees. Thereafter, the State Directorate issued a communication dated 08.12.2025 addressed to the principal/director of private Industrial Training Institutes (ITIs) informing them that the last date for free of cost migration of data was 24.11.2025 and thereafter, fixed fee of Rs. 100/- will apply from 08.12.2025 to 20.12.2025. The petitioner institute did not receive the aforesaid communication and no action could be taken by them. The petitioner Institute ultimately got to know about the aforesaid communication in the month of January 2026. Thereafter, the petitioner made several representations for migration of data to the SIDH portal but to no avail. It is stated by the counsel for the petitioners that a penalty has been imposed on the petitioners because of missing the prescribed deadline of 20.12.2025.

Mr. Kumar, learned counsel for the petitioners, states that even though the petitioner No. 1 institute does not admit that the petitioner has missed the deadline, but in order to put a quietus on the dispute the petitioner agrees to pay the penalty of Rs. 1000 per student to the respondent No. 2.

Further, it is stated by the learned counsel for the petitioners that it was the respondent No. 2 which failed to upload the data within time. The said contention is disputed by the learned counsel for the respondent No. 2.

Accordingly, the petitioner shall make the payment to the respondent No. 2 within 1 week from today and the respondent No. 2 shall transmit the

amount to respondent No. 1 within 1 week thereafter.

Immediately upon the receipt of the payment, the respondent No. 1 shall open the portal for transmitting the data which shall be completed within 1 week thereafter. The opening of the said portal shall duly be communicated to the petitioner. The verification of data shall be done before 22.04.2026.

With these directions the petition is disposed of, along with pending applications, if any.
