% 17.02.2026 1. This petition has been filed with the following prayers:

(a) Issue a writ of certiorari quashing the Transfer/ Movement Order dated 06.02.2026; and

¶14

(b) Issue a writ of mandamus to retain the Petitioner at 25th Bn, BSF, Chhawla Camp, New Delhi to ensure his survival through specialized medical care; and

(c) issue such further appropriate writ/order/direction as this Hon'ble Court may be deem fit and proper in facts and circumstances of the case.

The Movement Order 06.02.2026 has been passed to proceed to FHQ BSF Hospital-II, Tigri Camp, New Delhi for Hemodialysis. The case of the respondents is that the Movement Order has been issued as better

treatment/management is available at BSF Hospital, Delhi and in that sense the Movement Order is just an order to report to the aforesaid hospital for better supervision of the patient.

The submission of the learned counsel for the petitioner is that as the petitioner is undertaking the dialysis from the Venkateshwar Hospital, Dwarka, he should be allowed to continue to undertake the treatment from the said hospital and the Movement Order be withdrawn.

Learned counsel for the petitioner also submits that there is no Specialist available in the facility, which has now been established by the BSF. This submission, however, is contested by the learned counsel of respondents, Mr. Ali by placing before us the list of Doctors with their designations, who are supervising the dialysis at the aforesaid facility. The list reads as under:

All above mentioned doctors got trained for 3 months duration in dialysis from AIIMS New Delhi.

06 pers as shift observer also got trained from AIIMS.

We find and it is also agreed by learned counsel for the respondents that there is no Nephrologists attached to the aforesaid facility. If that be so, appropriate shall be that petitioner continues to undergo dialysis at Venkateshwar Hospital, Dwarka, as is already being done by the petitioner; now it follows that the Movement Order dated 06.02.2026 insofar as the
