Union of India) and connected matters — a batch of 110 writ petitions by Petitioners serving in the Central Industrial Security Force, posted in different cities, praying for a writ of mandamus to grant additional 5% HRA from the respective dates in chart mark 'C-1'. Learned counsel for the Respondents urged that under Rule 61 of the CISF Rules, 2001 read with Office Memorandum dated 31.07.2017 the Petitioners were not entitled to the additional 5% HRA. The Court held this objection was already considered by the Division Bench in Jaspal Singh Mann v. Union of India & Ors., 2009 ILR 1 Delhi 165, and other judgments, and could not be taken again; the said judgment had been upheld by the Supreme Court in Union of India & Ors. v. This is batch of 110 cases wherein identical prayers have been made. The Petitioners in all the writ petitions are serving in Central Industrial Security Force. They are posted in different cities. They pray for issuance of a Writ in the nature of Mandamus thereby directing the Respondents to grant additional 5% HRA from the respective dates as given in the chart which shall form part of this order as mark ‘C-1’.

In fact, the Petitioners claim that the matter in issue is squarely covered in their favour by a judgment passed by the Division Bench of this Court in the case of Jaspal Singh Mann v. Union of India & Ors. : 2009 ILR 1 Delhi 165.

Thereafter, there has been a series of judgments passed by this Court to the same effect.

By order dated 08.02.2024, the Hon’ble Supreme Court in the case of Union of India & Ors. v. Paramisivan M. : Civil Appeal No.

4967/2023 , has upheld the judgment passed by this Court in the case of Jaspal Singh Mann v. Union of India & Ors. ( supra ).

Learned counsel representing the Respondents submits that in view of Rule 61 of Central Industrial Security Force Rules, 2001 read with Office Memorandum dated 31.07.2017, the Petitioners are not entitled to additional 5% HRA.

It is evident that this objection was considered by Division Bench of this Court in the case of Jaspal Singh Mann v. Union of India & Ors. ( supra ) and other judgments. Hence, it is not open to the Respondents to take this objection once again.

In view of the aforesaid, the present writ petitions are allowed in terms of judgment passed by Division Bench of this Court in the case of Jaspal Singh Mann v. Union of India & Ors. ( supra ).

The Respondents are directed to release the amount payable to the Petitioners within a period of next 03 months.
