Delhi High Court (Amit Bansal, J; order dated 23.04.2026) disposed of W.P.(C) 18473/2025 & CM APPL. 26852/2026, in which the petitioner sought directions for action against unauthorised construction at Plot No. 98/9, Village Kishangarh, New Delhi, undertaken by private respondent no. 4. An earlier petition, W.P.(C) 4935/2025, had been disposed of on 07.11.2025 upon noting that the owner/occupier had already appealed before the ATMCD, which had meanwhile directed that no coercive action be taken. The ATMCD disposed of that appeal on 13.11.2025, remanding the matter to MCD with a direction to pass a speaking order after personal hearing; after hearings on various dates, MCD passed a detailed speaking demolition order on 16.04.2026. In view thereof, the Court directed MCD to take appropriate action in terms of that demolition order and directed the SHO, P.S.: Kishangarh/Vasant Kunj (North), to provide the necessary police force for carrying out the demolition. The present writ petition has been filed seeking directions to the respondent authorities to take action against the unauthorized construction at Plot No. 98/9, Village Kishangarh, New Delhi (hereinafter the ‘subject property’), undertaken by the private respondent no.4.

of Municipal Corporation of Delhi and Ors. ”, was filed, which was disposed of vide order dated 07th November, 2025, by noting the fact that the owner/occupier of the subject property had already filed an appeal before the Appellate Tribunal Municipal Corporation of Delhi (“ATMCD”), wherein, it had been directed by the ATMCD that no coercive action shall be taken against the subject property.

Notice in the present writ petition was issued on 4^th December, 2025.

A status report has been filed on behalf of the respondent-MCD.

4.1. A copy of the same has been handed over in Court today and the same is taken on record.

4.2. A copy of the said status report has also been handed over to counsel appearing on behalf of the petitioner and counsel appearing on behalf of the private respondent no. 4.

Earlier, the appeal filed on behalf of the private respondent no.4 was disposed of by the ATMCD on 13^th November, 2025, remanding the matter back to MCD, with a direction that MCD shall pass a speaking order after giving a personal hearing to the private respondent no.4.

Pursuant to the aforesaid order, personal hearing was granted to the private respondent no.4 on various dates and a detailed speaking demolition order was passed by MCD on 16^th April, 2026.

In view thereof, it is directed that the respondent-MCD shall take appropriate action in terms of the aforesaid demolition order.

The concerned SHO, P.S.:Kishangarh/Vasant Kunj (North), shall provide the necessary police force to the respondent-MCD for the purpose of carrying out the demolition action.
