The present writ petition has been filed seeking a direction to the respondent/MCD to stop the unauthorised construction at Farm - Western Green, Khasra No. 43/12, 43/13, West Circular Road, Village Dera Mandi,

Mr. Pritish Sabharwal, counsel appearing on behalf of the respondent/MCD, on advance notice, submits as follows:

i. Unauthorised construction in the form of ground and first floor in the subject property has been booked and a show cause notice has been issued on 8^th September, 2026.

ii. Further, a work-stop notice has also been issued to the SHO, P.S. Fatehpur Beri on 9^th September, 2026.

iii. A communication dated 9^th September, 2026 has also been sent to the Sub-Registrar, Mehrauli, to ensure that no transaction in respect of the subject property is registered.

iv. Another communication dated 9^th September, 2026 has been sent to BSES, Rajdhani Power Ltd. and to Delhi Jal Board, intimating the action being taken against the subject property.

3.1 All the aforesaid documents have been handed over in Court and the same are taken on record.

Accordingly, the present writ petition is disposed of while directing the respondent/MCD to take appropriate action in accordance with law in an expeditious manner. A direction is issued to the SHO, P.S. Fatehpur Beri to ensure that in terms of the work stop notice dated 9^th September, 2026, no construction is carried out in the subject property.

The order shall be communicated to the concerned SHO, P.S. Fatehpur Beri through Mr. Niraj Kumar, Advocate, who is present in Court.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.
