The sole grievance of the petitioner pertains to seeking a direction to respondent no. 1¹ and 2,² to inquire into and take appropriate measures concerning the conduct of, inter alia , the Sub-Divisional Magistrate, Narela, („ SDM ‟) who while passing an order dated 20.02.2024 (“ said Order ”), has allegedly exercised powers under Section 145 of the Code of Criminal Procedure („ CrPC ‟), 1973, on a complaint from a private person.

It is contended by the petitioner that earlier a complaint was rejected, and later, under almost similar circumstances, powers were exercised by the SDM and the said Order came to be passed.

This Court is of the opinion that if the petitioner is aggrieved by the

said Order passed the SDM, the same may be challenged in accordance with law. Rendering an order qua a complaint, where the same was previously rejected, does not warrant a disciplinary inquiry being conducted by the Lt. Governor or the Chief Secretary, into the affairs of the SDM, particularly when there is no proven case of misconduct. There cannot be a direction for roving inquiry.

The Court, however, leaves it open for the petitioner to take any recourse available in law. The petitioner may also pursue its complaint with the concerned authority.

Accordingly, in light of the aforenoted finding being reached, and while granting the above-noted liberty to the petitioner, the instant petition stands disposed of.

All rights and contentions of the parties are left open.
