The Tribunal's assessment of 50% functional disability for computing loss of future earnings is correct and reasonable; there is no infirmity in it. Following Raj Kumar v. Ajay Kumar, functional disability must be arrived at by correlating the claimant's vocation with the nature and extent of the injury — here, a full-time driver whose livelihood depends on continuous use of the right lower limb, suffering a non-progressive 29% permanent physical impairment of that limb. The insurer's contention that the percentage should track the 29% medical disability is rejected, and the author finds no reason to interfere with the Tribunal's assessment.
