The parties are present with their counsel in the Court. They submit that they have settled the grievance raised in the instant suit by way of a settlement agreement dated 07.02.2025.

In compliance with the settlement agreement, two demand drafts bearing No.082526 dated 15.02.2025 of Rs. 46,00,000/- in favour of defendant No.1 and No.082525 dated 15.02.2025 of Rs. 31,00,000/- in favour of defendant No.2 have been handed over to respective parties in the Court.

Additionally, the impleaded defendant, M/s S&B Infracon Pvt. Ltd., through its Director, Mr. Bimaldeep Singh, who is present in Court, has handed over three demand drafts bearing no. No.799529, No.799530, and No.799531, dated 03.03.2025, for Rs.11, 00,000/- each in favour of plaintiff No.1A, defendant No.1, and 2.

Learned counsel for parties submits that as per the settlement agreement, the instant suit can be disposed of.

Order XXIII, Rule 3 authorises the Court to pass a decree on a compromise wherein the parties to the dispute have made an arrangement to settle the dispute. It has been comprehensively stated in the provision that the settlement arrived at should meet the essentials laid down therein, namely, (i) the compromise is lawful (ii) it is reduced in writing (iii) it is duly signed by the parties arriving at the compromise.

The settlement has been agreed upon without fear or coercion and the parties appear to have entered into the settlement agreement on their own volition.

All the parties are present in the Court, and their identity is verified by learned counsels who appear on their behalf.

¶19

The Court is satisfied that the settlement has been arrived at between the parties following due procedure and meeting the essentials specified in Order XXIII, Rule 3. Therefore, the parties shall be bound by the aforesaid settlement agreement.

In view of the aforesaid, the civil suit stands decreed in terms of the settlement agreement.

The Registry is directed to draw a decree sheet.

The civil suit along with the pending applications stands disposed of.
