This is an application under Order XXIII Rule 3 of the CPC on behalf of the parties for recording the compromise and disposing of the suit in terms of the compromise entered into between the parties.

The present suit is one for partition, rendition of accounts and permanent injunction. During the pendency of the suit, the parties have entered into a settlement on 28.10.2025. Though the Memorandum of Understanding does not mention any date but the e-stamp certificate is dated 28.10.2025. The entire Memorandum of Understanding dated 28.10.2025 is reproduced as under:-

Clause 10 of the Memorandum of Understanding states that the parties shall jointly file an application under Order XXIII Rule 3 of the CPC for recording the compromise and dispose of the suit in term of the compromise.

The present application is supported by the affidavit of all the parties. This Court has perused the Memorandum of Understanding which is legal and therefore is enforceable.

In view of the above, the suit is disposed of along with pending application(s), if any, in terms of the Memorandum of Understanding entered into between the parties. Both sides are bound by the terms of the compromise.
