The petitioners and respondent no. 2 have appeared before this Court in person. They have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Tilak Nagar, Delhi.

Briefly stated, facts of the present case are that the marriage between petitioner no. 1 and respondent no. 2 was solemnised on 18.01.2019 according to Hindu rites and customs. It is stated that no child was born out of their wedlock. It is stated that due to temperamental differences, both the parties started residing separately since 04.03.2020. On the complaint of respondent no. 2, the present FIR was registered against the petitioners. Respondent no. 2 had also filed a petition under Section 125 of CR.P.C. against the petitioner no.1 before the Family Court, Tis Hazari Courts, Delhi. Thereafter, with the intervention of the relatives and family members, both the parties have amicably settled their disputes vide Settlement Deed dated 06.03.2024, entered between them before the Delhi Government Mediation & Conciliation Centre.

On the last date of hearing, the complainant was present before the Court and had given her statement that she has no objection, if the FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
