By way of the present petition, the petitioner seeks quashing of FIR bearing no. 170/2024, registered at Police Station Chanakaya Puri, Delhi for the commission of offence punishable under Section 281 of the Bharatiya Nyaya Sanhita, 2023 (hereafter ‘BNS’ ).

Briefly stated, the facts of the present case are that on 25.10.2024 at about 08.00 PM when the respondent no. 2 was going from Mustafa Kamal Ataturk Road near PM House Chanakaya Puri, New Delhi, while crossing the road, he had got hit by the vehicle bearing No. HP63A8463 INNOVA which is owned and was being driven by the petitioner herein. It is stated that on the complaint of respondent no. 2, an FIR bearing no. 170/2024 was registered at Police Station Chanakaya Puri, Delhi, for offences punishable under Section 281 of BNS against the petitioner. During pendency of the case, both the parties had amicably settled their disputes vide Settlement Deed dated 28.03.2025.

On a query made by this Court, respondent no.2 who has been identified by the IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no.2 that the entire dispute has been amicably settled/compromised between them Respondent no. 2 further stated that he has no objection if FIR may be quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
