Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( old Section 482 of the Code of Criminal Procedure, 1973 ) has been filed on behalf of Pawan Kumar @ Vats, the Petitioner for quashing of FIR No. 43/2021 under Section 354/354(B)/509/506 of the Indian Penal Code, 1860 registered at Police Station Sector-23, Dwarka including the ChargeSheet dated 10.05.2021.

Learned APP for the State, submits that the Charge-Sheet has already been filed and the matter is pending at the stage of Arguments on Charge.

The quashing of the FIR is sought essentially on the ground that the Complainant had asserted in her Complaint that there was a dispute in regard to the unauthorized construction when in fact there was no such previous dispute. She has made allegations of assault and of her son being

beaten and threatened. However, the incident gets refuted by the CCTV camera footages, which have been filed before this Court, to reveal the truthfulness of the incident. Certain references to DD Entries have also been made. Essentially, it is on merits that it is contended that no offence is made out.

The Petitioner is at liberty to address all these contentions before the learned Trial Court as the matter is already pending at the stage of Arguments on Charge. There is no case made out for quashing of the said FIR. The Petition is disposed of accordingly.
